Question Details: My mother died a few years ago, as far as we are aware, intestate. She was predeceased by my only sibling, who had three children (who are still alive). Who inherits her property - myself as her sole surviving offspring; or is it divided in some other manner? How can I get this matter resolved and will it be expensive?

If a person dies intestate, their estate can be distributed to relatives according to the rules in the Administration Act 1969. You can find out more information on that process by clicking here: www.communitylaw.org.nz.
The fact that your mother died a few years ago and this has not been dealt with yet may make your situation difficult. If you want to pursue your mother's assets, use the NZ Law Society's "Find a Property Lawyer" search tool (www.propertylawyers.org.nz - check the box marked "trusts and wills") to find an appropriate lawyer near you. Make sure you mention to them how long ago your mother passed away.
