Can I report OSH breaches by my ex-employer?

Question Details: I was dismissed from my job for unsafe practices. Can I now report other similar unsafe practices by this employer; and how can I do this?

Yes, anybody can report unsafe work practices to the Ministry of Business, Innovation and Employment - see www.osh.govt.nz.

However, we note you were dismissed for this type of activity. As well as criminal offences being available for employers who are breaching the Health and Safety in Employment Act, employees can also be charged in some cases for their own personal conduct in the workplace. You will therefore need to consider whether your complaints are incriminating yourself when you make them. You may wish to seek further legal advice if that is the case.
